Accident Basics
Generally, if you have suffered injury as a result of someone else’s negligence or intentional action, you may be entitled to compensation for your injuries or damages. When you consider whether someone has injured you, you must consider whether you were injured when someone did something that caused you to suffer harm. For example, when someone causes their car to collide with you or a car in which you are riding, whether they intend to hit you or not, you typically have a claim against that person for any damages you suffer.
When a lawyer attempts to prove that you have been injured, he does that on two levels. The first is on an economic level. What that means is did you lose money or property as a result of the accident. For example, if someone’s dog bites you, you may not only have been physically injured by the dog bite. You may also be unable to perform your regular duties at the job or career at which you are employed. Loss of wages or the ability to earn wages at your previously established amount is an economic damage. Maybe you were wearing the beautiful shirt your children got for you for your birthday. The shirt may have value on both levels. The price of the shirt is an economic loss.
Here are some quick rules to follow if you are injured in an accident:
Remain Calm. Remaining calm is the first step to helping you evaluate your situation after an accident The initial shock of the accident may cause you to be disoriented, and your composure is important to decide what, if any, effect it has had on you.
Check to see if you or anyone else involved has been injured. Injuries are very common, especially in traumatic accidents. After an accident you may not be aware of the seriousness of an injury; therefore, it is important to carefully and slowly whether there is any difference in your body caused by the accident. Obviously, any broken bones or bleeding warrant immediate attention, but don’t forget to check for other less apparent injuries.
Call the police. Except in the most minor of accidents, the police should always be called to properly record and preserve the accident scene. The police report may be crucial to evaluation by an insurance company or attorney.
Call an ambulance or go to the hospital or doctor. If you believe you are injured as the result of an accident, it is important to get professional advice as to the extent of your injury. Sometimes the shock of an accident can mask symptoms of serious injury and an examination by a trained professional helps to make sure that you receive the proper care.
Call your lawyer. A qualified lawyer can assist you in knowing your legal rights after an accident has occurred. My office will fight for you to obtain the compensation to which you may be entitled.
